Scozia, il diritto di acquisto del proprio club da parte dei tifosi giungerà in Parlamento

La commissione del Governo scozzese nei giorni scorsi ha promosso e approvato l'inserimento di un emendamento al Community Empowerment Bill, iniziativa di legge in discussione per regolamentare e favorire le procedure per l'acquisto di beni di interesse pubblico, per estendere il diritto di acquisto(Right-to-buy) anche ai club di calcio da parte di soggetti specifici(qui LINK al documento).
L'emendamento presentato da Alison Johnstone, Green party, se approvato dal Parlamento scozzese, darebbe le facoltà di prelazione ad entità specifiche, registrate con un specifico interesse rivolto al calcio(come ad esempio i Supporters' Trust), per l'acquisto del club di riferimento, qualora fosse messo in vendita, e facoltà di acquistare azioni della società, fino anche ad ottenerne il controllo, in qualsiasi momento del sua vita.
In questa sua prima formulazione l'aspetto più praticabile sembra essere la facoltà di avere il diritto di prelazione sulla messa in vendita, più complicato sviluppare un discorso sul diritto di acquisto in qualsiasi fase della vita del club che sembra più difficilmente applicabile in un contesto di mercato aperto con la Scottish Football Association che ha già espresso una dura presa di posizione contraria nei confronti di questa iniziativa di estensione della legge e di questo particolare aspetto.
La politica scozzese inizia così ad occuparsi seriamente, e con colpevole ritardo, del crollo del calcio scozzese dell'ultimo decennio e della necessità di revisionare le attuali dinamiche di governance che hanno evidenziato lacune profonde, a cui si è aggiunto lo scarso controllo esterno, ed hanno condotto ad un susseguirsi di dissesti finanziari, con la vittima illustre dei Glasgow Rangers tra gli altri, rinato come Rangers FC e ai casi positivi di Motherwell FC, East Fife Football Club, Heart of Midlothian e Dunfermline Athletic FC tra i più recenti ad aver visto l'intervento massiccio e decisivo dei supporters.
L'emendamento potrebbe aprire scenari più favorevoli per lo sviluppo dell'intervento delle associazioni di tifosi che, nonostante le avversità attuali, hanno svolto un ruolo decisivo in diverse realtà prevenendone il fallimento, tanto da far partire nel corso del 2014 un gruppo di lavoro del Ministero per studiare le buone pratiche e sviluppare strumenti per incentivare e agevolare il coinvolgimento attivo dei tifosi(qui dettagli).

"It's great that parliament has today united around the principle of a responsible fans' right to buy their clubs."
The Scottish Green MSP said that, if passed by the full Scottish Parliament, fans would have "nothing to fear from irresponsible owners like those who have undermined so many clubs".
She added: "We know there are plenty of good private owners of clubs, and this will not require fans to buy them out, but when they move on, fans will be in the right place to take over if they wish."
Ms Johnstone's amendments bring the principles of rural land reform laws, which help communities buy land, to supporters of football clubs.
Local Government Minister Marco Biagi said the Scottish government wanted to give fans the right to buy their clubs using regulations which would be put in place after the bill was passed.
"Affirmative procedure for the development of the details, with the aim put in the bill, would allow consultation with the wider football community; it would allow consultation, as appropriate, with the parliament; and it would ensure that we don't just endorse the principle but we ensure that any legislation we introduce we get right," he said.
Scottish Labour's Ken Macintosh, who supported Ms Johnstone's amendments, said: "I believe it would be difficult for anyone in Scotland to stand up and defend the current state of Scottish football in terms of its accountability, its sustainability or simply its success.
"Football fans and local communities have not only lost out, they have been made to feel powerless, sometimes even taken advantage of or had their goodwill exploited."

“We welcome the principle of these amendments, although we recognise that another round of discussion will be required before the Community Empowerment Bill is considered at Stage 3, and that additional changes may be needed to allow other ownership models to be included. Using our considerable expertise and experience in this area we stand ready to help the Scottish Football Association, the Scottish Professional Football League and the Scottish Government refine these proposals so they can best empower supporter ownership and enshrine the voice of supporters in our game.”
